Terms and Conditions
1. Definitions
1.2. Any reference to the ‘User’, ‘you’ or ‘your’ means the person (including a private individual or corporate entity) who is a specified as the user of the site.
1.3. Any reference to the ‘User ID’ means the user identification provided by us to you to enable you to access the website.
1.4. Any reference to the ‘Information’ means any and all information, available to you, contained on the website.
1.5. Any reference to the ‘Password’ means the single use password provided by Paycare, or any subsequent password chosen by you to enable you to access the website.
1.6. Any reference to the ‘Services’ means the provision of online services including but not limited to access to the Information and any business activities which are conducted electronically, by Paycare.
1.7. Any reference to “Paycare Online” means the online service of Paycare.
2. Residence / Eligibility
2.2. Paycare does not make any warranties, express or implied; that the Information and the Services or the availability of the same in any particular jurisdiction outside the UK is compliant with applicable local laws or regulations or that the Information can be legitimately used outside the UK.
2.3. You (the User) must satisfy yourself, before using the Services, that you are lawfully entitled to receive the Information and use the Services. Paycare accepts no liability for any costs, losses or damages resulting from or related to the availability of the Information and use of the Services in respect of persons in jurisdictions outside the UK or to persons who are nominees or trustees for citizens, residents or nationals of other countries.
2.4. Neither the Services nor the Information or any part thereof shall be deemed to constitute an offer or solicitation to sell investments in any jurisdiction.
2.5. Paycare reserves the right to refuse any application for the Services without disclosing any reason.
3. Registration / Security Precautions / Operating Rules
3.2. Your Password must be between five and fifteen characters long and should not be obvious. You must memorise your login details and must not disclose them to anyone, including a member of Paycare staff. A member of Paycare staff should never ask you to disclose your Password to them. You should not record your Password in such a way that it can be identified with any of your Paycare products or can be understood by anyone else. You should not store your Password on your computer or ask your computer to remember it automatically.
3.3. If you believe that someone else knows your Password, you must change it. You can do this yourself using the online facility. If you fail to do so, we will not be responsible for any person having access to your Information or loss suffered by you.
3.4. Some companies may offer to collect and manage financial account information for you and then display this information in one place such as a single web page, and/or carry out transactions on your behalf using your Email and Password. These services are sometimes known as aggregation services. The company offering such aggregation services may ask you to disclose to them your Email and Password and may ask you to appoint them as your agent for the purposes of providing the aggregation services using your Email and Password.
You must not disclose your Email and Password for Paycare Online to a provider of aggregation services and/or, appoint a third party as your agent to access Paycare Online using your Email and Password.
Paycare has no control over such aggregation services and cannot ensure the accuracy of data displayed or instructions transferred to us by such aggregation services. We cannot ensure the security of data or Email and Password held by the aggregation service.
IF YOU DO PROVIDE YOUR USER NAME AND/OR PASSWORD TO AN AGGREGATION SERVICE IN BREACH OF THIS CLAUSE YOU WILL BE RESPONSIBLE FOR ANY LOSS OR EXPENSE SUFFERED BY YOU AS A RESULT OF THIS DISCLOSURE.
3.5. You must not access or attempt to access any information other than the information relating to you as a User. It is an offence under section 55 of the Data Protection Act 1998 to access any information by means of the Services other than information relating to you as a User. If we have reason to believe that an attempt has been made to access any information through the Services in breach of Section 55, we may revoke your access in terms of Clause 4.3 below. We may also report our suspicions to the Information Commissioner (the supervisory authority which enforces and oversees the Data Protection Act 1998) and/or the police.
3.6. You must logout of these pages or the site you have accessed and close your web browser when you have finished using the Services. If you do not do this, Information about you may appear on the screen of the computer when it is next used and we cannot be held responsible for any person having access to this Information.
3.7. Promotional Services: The “Recommend a Friend” and “Recommend a Colleague” offers do not apply to company contacts or company paid groups and cannot be combined with any other promotional offer. Vouchers will be issued once the first month’s premium has been received from the recommended friend or colleague.
4. Availability of the Services
4.2. We make no warranty or representation that the Services can be accessed at all times during the hours of business stated on the website. The Services may be temporarily unavailable or restricted for administrative or other reasons. We will not be liable for any loss or damage arising out of or in connection with the loss of use of the Services.
4.3. Without prejudice to the foregoing, we reserve the right to revoke your access to the Information without notice if:
4.3.1. We suspect that an unauthorised person is attempting to access the Information, or
4.3.2. For valid operational reasons, we believe it is necessary to do so.
5. Instructions
5.2. If you have not completed your instructions in relation to your transaction and have not received final confirmation of your transaction, your instructions will not be received by us.
7. Changes to these Terms and Conditions
8. E-mail
8.2. We reserve the right to monitor the use and content of e-mails which are sent from, and received by, us for the purposes of ensuring compliance with our own e-mail policy, and identifying and taking action against unlawful or improper use of our systems, including, but not limited to, spoofing, the transmission of computer viruses and a denial of service attack.
9. Use of Personal Data
9.2. You can find a list of our purposes for which we hold personal information and a description of the general categories of parties to whom we may disclose it in the Privacy Notice.
9.3. You have the right under the Data Protection Act 1998 to request a copy of the personal data which we hold about you. We reserve the right to charge an administration fee to provide this data under the Data Protection Act 1998.
10. Termination
10.1.1. The User is in breach of any of these terms and conditions, or
10.1.2. The User is, in the reasonable opinion of Paycare, in breach of any generally accepted guidelines on internet usage and etiquette (including, but without prejudice to the foregoing generality, restrictions on pirating or copying software or attempts to violate security).

12.2. Any such notice shall be delivered personally or by first class post or facsimile transmission and shall be deemed to have been served, if by hand, when delivered, if by first class post, 48 hours after posting and, if by facsimile transmission, at the time the transmission is electronically confirmed.
13. General Disclaimers
This site and these conditions are governed by English law. Any disputes arising from this site shall be resolved by the English courts, unless you can show you accessed the site from Scotland in which case the Scottish courts may be used.
